7440 w/ Dell 1601 2x2 BGN can see 5ghz but cant connect

I just purchased a e7440 from the Dell depot, and I can see the 5Ghz band from my ASUS RT-68N (Top tier N router 3x3) and can view it from inssider but every time I try to connect to it from Win 8 it fails.

My old 6430s with a centrino 6205 picks it up immediately....

All latest dell drivers and bios are installed, fresh win 8 build.

Ideas?
