Via my warranty HP is sending me a new pavilion d9000 to replace the one that gave lots of grief, but where the old one was loaded with oem xp media edition the new one is being shipped with oem vista. If I reformat can I load it with my oem media center discs or an oem xp sp2 which I was using on another hp notebook and still activate either one?

Technically, you cannot move an OEM install to another PC. However, given the laptop died...well, MS had at some point said something about it being okay...so I'd say this is a legal gray area to be honest.

The XP MCE discs you had were specific to the old laptop and *may* not work since you are getting a new model. Plus, you might need the XP key that was on the old laptop's bottom sticker...so you might not be able to do anything about it.

To be honest, I'd say play it safe and see if you like Vista.
