    My Laptop is gone

    Hi Dear Fourm , MSI team.

    I have MSI gt73vr tittan pro top of the line laptop which I bought on december 2016



    I sent my laptop to MSI RMA service to fix it for the 4th time within 1 year becuase I had a defective unit, MSI team were great each time and fixed my laptop for me which I barely used ,because every time i use this laptop it will fail me and break so I use my 6 years old HP laptop instead , which still works great :)


    anyway this time when the repair was completed ,RMA departement sent the laptop for me throw fedex,on may /30 I got a message from fedex telling me that my package was delivered and someone has signed and recived the pakage,I was at my work so I contacted my family members who live with me they told me they were out also and havn't seen any one,



    I checked with the apartment manager , and he hadn't recived any thing,so I contacted fedex and they told me that MSI has to file a lost claim

    I called MSI team and they were great again and help me to file the claim,the claim got declined becuase someone has signed , i called Fedex agian and they told me they can do more invitigation and see who signed but MSI has to contact them directly becuase they are who did the shimpment I can't do it by myself



    I called MSI agian and they told me they did thier part and they can't help me more because my case will be declined agian ,

    I contact the supervisor (Kelvin Wong) throughthe phone and through the emails and I have attached a picture of what happend between us



    the last thing I heard from him was there is nothing we can do , and he hang up the phone on me !
    I left voice mails on his phone number and he has never contacted me agian



    So what I can do Now it is a 2 years investment for me that cost more than 2700$ and recently I upgraded the Storage to 512 Samsung NVME drive for 200$

    How in the hell can someone sign for a package in your name if it's not you?
    Clearly it's someone at your apartment complex...but that's absurd....sorry for your loss. But there's nothing anyone can do here for you. Contact your credit card company or take it to small claims court.

    Acually the one who has signed , has sign with another name , not my name ,
    MSI comapny is the only one who can declined Fedex decision and ask for more invistigation , but the supervisor clearly said to me that he can't do anything ,and hang up the phone !!!!!!

    Someone signing with the wrong name? Fedex should handle that. That was clearly illegal.
    The driver should never have released that package.
    You need to contact the Fedex district office, and also maybe contact a lawyer.

    yes I think this is really a good idea, but i'm afraid that the lawyer will cost me more than what i have lost already

    Contact your local police department and file a report. Then file a small claims case against MSI to take their ass to court over it. I would also contact your credit card company that was used to pay for the laptop with and file a charge back against MSI or the vendor which you purchased the laptop from.

    Lots of companies show the signature on the tracking page, thats why they use PDA's, the signature is digitized, and they usually also have the address/GPS coordinates of where the delivery was made.

    Someone signed that at some place, Fedex should show you the signature and where and when it was delivered.

    Did you insure your laptop? If so, claim it from the insurance. If you give them all the information they will go after either FedEx or MSI. If you did not specifically insure, some credit cards do insure the goods if over a certain value. Check with them.

    You do need to file a police report though.

    And check sites like Craigslist or Kijiji as sometimes these get sold and if you spot it you can let the police know.

    If someone else received the system chances are they're neighbors. I'd go to the police first. Setting up the RMA would have required a serial number, give them that.

    For some additional context regarding the signature discrepancy, most FedEx packages do NOT require a direct signature from the "intended recipient". They only require a signature from literally anyone at that location (over the age of 18). FedEx assumes that other people signing for packages are either family or friends of the package recipient. Additionally (and more significant than you might first think), FedEx also uses this practice to protect their employees. There have been several cases in the past where FedEx delivery employees have been physically assaulted because the intended recipient was not there to sign for the package (violence is never the right answer, but, I can understand that it would be frustrating to have a package you've been waiting for literally inches from your hands and the FedEx guy tells you "no").

    If I were you, I'd try to figure out the full name of whoever signed the package (but, they could have signed a fake name too... it's not like FedEx has a way to verify names in real-time when a package is delivered). Definitely contact the police as well.

    By the way, in the future, if you ever can NOT be home to pick up a package you are waiting for, DO NOT ALLOW FED EX or UPS to deliver it !
    You can manually request that they HOLD it at their warehouse and you come pick it up in person.
    That is perfectly legal and allowed.
    If you do that, they are required by law NOT to deliver a package that you requested held at their warehouse for pickup.
    That way you will never have such an incident EVER happen.
    If you can be home and wait for the day, have them deliver it as usual.
    If you can't be home, requests manual pickup, or even another scheduled delivery date !

    This is VERY important when you are at an apartment, which tend to be very unsafe areas, with many people who are complete low lives living in them, especially if they are not upscale apartments.

    It should be noted, depending on the contents of the package and the shipper's preferences, they can actually prevent the "hold at location" requests from being available. That being said, it is normally available.

    Yeah, it can be a bit tricky with high-value electronics. A lot of shippers actually prevent anyone who is not on their "white list" (on the shipper's FedEx account) from requesting a pickup. Not to drag FedEx through the mud or anything, but there have been plenty of times where some random person walks in and says "Hey, that's my package!" and the FedEx employees don't even check ID before handing it over. For that exact reason, there are a lot of shippers who do not allow pickup requests.

    Update :fedex finally accepted my lost case
    But MSI told me they will send a refurbished unit which I refused ,
    And they don’t want to cooperate with me
    I still don’t understand why msi involved in this case ,at the beginning they told me it is not there problem
    And now they want to send a refurbished model

    So now you want a brand new laptop replacement for your 2 year old laptop?? Get real man! Be happy you are getting a refurbished one and count your blessings you had nothing just a few days ago.

    Depends on the value assigned to the loss by Fedex, he might be better compensated by Fedex than by taking a refurbished laptop from MSI.

    Besides there's more than just a used laptop lost, there is the comfort and ease from ownership of that laptop, knowing the in's and out's, and having it just the way you like it - except for the RMA reason, of course. That's worth more than just the appraised value.

    The pain and anguish of this series of events: problems that required RMA - RMA return hassle - wasting time waiting - then the loss of the laptop and him left hanging - is also worth something, and he should be compensated - getting a used laptop with who knows what troubles of it's own included isn't what I would want to take either.

    If he can get a fair compensation from Fedex, he can apply that to a new laptop and almost be at an even stance from his loss.

    If he takes the MSI laptop right now, it's over.

    I'd wait for the compensation offer and negotiation from Fedex to be over before deciding on taking the MSI re-tread.

    Yeh, I don't think that by refusing the refurbished unit offer @hussamalnajjar2012 meant he wanted just a brand new one.
    I'm pretty sure he'd still rather have his own laptop and his nerve cells back instead of all this...
