If I get a new comp and immediately swap out the processor for a different one, do I have to sell the removed CPU as used? Are there any popular places to sell it?

Sounds more like a moral issue than a technical one.

    Did you turn it on?
Is it out of the packaging?
Did your swap void the warranty?
    Was the replacement processor used?

you can just describe the situation in detail. if its on ebay and you have to pick "used" or "new" - choose "used" and then clarify in your ad. that way, people will get a good feeling associated with the sale. Its just another way to underpromise and overdeliver, which is always the mood you want.

I would post it up in the buy and sell section here, and state that the processor was removed from the system before powering up for the first time.
However, many cpu buyers will probably want you to test the cpu, so they know they are getting a working part.
However, do not expect to get full retail value, since it is unboxed. I think you can get about 75% of the retail price back or so from selling it.

If I'd sell it on ebay I would pick 'new' and then clarify in the ad.

In my opinion it is new if you've never used it.
