If you are within your 21 days then you shouldn't have any problem. Just make sure to mention it to the rep when you speak to not charge any rest. fees.

I've kinda been wondering this too. Do you have to give any specific reason for the return that won't trigger a restocking charge?

Personally, I told them about the throttling issue and how underpowered the laptop is and how "fire hazard" the adapter can be because its gets very hot :D
They didnt give any hard time but then again because I was dealing with the dell corporate office reps directly which were very courteous and helpful.

When you send an email to Micheal Dell someone from Dell corporate will contact you. It happened to me and to multiple users in this forum.

I sent an email to Michael Dell and it seems like those emails are directed to Dell India now. Got a call from them telling me I'm out of luck since my laptop is now out of the 21 day period. The anger is building inside me.

File a credit card dispute man. It's real easy. Explain to your credit card company that Dell committed fraud and sold you a laptop that was not as advertised, and furthermore Dell covered it up by making false claims of fixes and patches. Also mention that you tried in good faith to deal with Dell directly. If every person that has this problem does this after being denied a return, we will have Dell's attention, as well the credit card companies. I'm not sure about this, but Dell has to still pay a 3% or so to the credit card companies, so Dell is losing out big time. This works with all major credit cards.
