    Was I Scamed?

    Hey everyone, I basically wanted to just vent a little and also get your opinions on what I should do. I recently purchased an A8Jm system... I love this system. When I got it, it was a sealed box, so I obviously thought that there was nothing wrong with the system. Usually when I get a new system, I format the HDD and load a fresh copy of windows on the the drive. I like less programs. While I was formatting this computer, I noticed that windows was only detecting this drive as a 40GB. I thought nothing of it, and proceeded to load the drive. When windows came up, I checked the properties, and windows was still reporting the drive as a 40GB. Because of this, I decided to check the BIOS settings, and sure enough, it was a 40GB. So I go back to the store I bought it, and tell them. After lots of running around and calling Asus, they tell me to bring the computer to Asus. I did that, and they gave me a new 100GB drive. I was happy. But now, today, they call me back and say that the 40GB is not theirs and they want me to return the 100GB. If I do not, they will keep my system if I bring it in for repairs. Now, I know Asus is a big brand, and it probably won't break within the short 1 year warranty, but it's just the fact that they are point fingers and blaming me. Also, I have to live with the fact that someone opened my computer, and replaced parts of my system before I got it. Is this fair? this is a 2k CAD system, and they are blaming me for trying to rip them off an extra 60GB? I will be calling the head office of Asus today to talk to Patrick Wang to dicsuss this matter further. But, I was just wondering, do yuo guys have any ideas on what I should do if they still blame me for replacing the drive with a 40GB just to get another 100GB drive? Sorry for the rant, and thanks.

    Where did you buy this A8Jm from? Tough situation... could be 1 of 2 things I think:
    - The reseller replaced the HD
    - ASUS originally made a mistake and put a 40 GB in there.

    But hopefully you'll get someone reasonable at ASUS who can help you out.

    did the 40gig drive have the asus restore partition before you formated? if it did it came from asus that way.

    Yes you should be taking this issue up with your retailer....they are most likey to blame or at least give you an idea of what/where the problem lies.
    Ditto on the restore partition, did you do a complete low-level format? was there still a hidden partition? Im assuming ASUS checked the drive out found no hidden partion and thus think you did a switch yourself.

    Okay, what you should do is to contact your retailer. Explain the problem. Tell them that they must resolve this problem for you. If they don't IMMEDIATELY resolve the problem, go down to small claims court and file a complaint for the value of a new 100GB 2.5" hard drive.

    You'll most likely find that the retailer resolves things quickly from there and probably offers to settle. Make sure you settle only for the price of a new 100GB hard drive PLUS COURT COSTS.

    Very important, though, that you exchange the 100GB hard drive for the 40GB hard drive from ASUS if the retailer doesn't sort things out immediately. Also, take down a letter to ASUS that states that the 40GB hard drive was not factory installed by them, and have them sign it.

    Chances are good, though, that the retailer will sort things out today. Whatever you do, be very polite with your retailer and with ASUS. Only tell them you will sue them AFTER they fail to resolve your problem.

    Small claims is really easy.

    Fortunetly. After talking with Asus, they have decided to let me keep the drive. Thankfully I at least get my 40GB HDD, but the only thing that I worry about is that what else could have been swapped? Maybe my ram got swapped for used old ram. checked my system settings, and the rams is still at 1GB. Asus says that, maybe one of the testers had left their 40GB drive in my system. I hope that was the case, because with a short 1 year warranty, I could find myself paying quite a bit if my parts start to break down. But all in all, I love this system. It's great, and much better then my last, an Averatec. =)

    i would bet is was just a mistake. You said the box was sealed. as everyone knows its alot easier taking everything out of the box i can never out them back together right.

    Wow. What an experience. I once bought a desktop for our office. I brought it home, and it would not POST. After a few minutes of fiddling, I brought it back to the retailer. They found out that there was no ram in the machine!

    Suppose that a retailer have to show the machine in the front of a customer, at least they can prove that they pick up a right machine without any problem, and let me be happy before leaving.
