I've had my 80 gig 5th generation ipod for a couple years now and my apple care warranty is about to expire. Although nothing is apparently wrong with it do you think apple will use the replacement feature of my warranty if i tell them the battery is not holding its charge or will they attempt to "fix" or repair the "issue"? Basically, I want to take advantage of the warranty while i still can.

That's not taking advantage, that's scamming them straight up lol. While I don't think it's legal, the answer should be yes, if there's something wrong with it that's not fixable/repairable then sure they should believe you and replace it. I don't think it's worth the hassle though, it's just an iPod and it should be fine.

They will just replace the battery at best. IMO not worth it unless your battery really isnt holding much of a charge.

i dont know how some people are stupid enough to ask questions on fraud and make known their intentions to commit fraud on a public forum.

Taking advantage of a warranty when you do not have a warranty claim(ie nothing wrong with it) is fraud and discussion, as mentioned is against the forum rules.

If you have a valid problem that the warranty covers, then contact Apple. If not, then be happy with you Ipod.
